Abstract

In Islamic law, the consent of a woman in Nikah (marriage) is essential and cannot be ignored. A valid marriage requires her free will, she cannot be forced or coerced. Islam recognizes her as an independent individual with the right to accept or refuse a marriage proposal, emphasizing respect for her choice. The role of her guardian (Wali) is important but cannot override her decision. Her consent is the key factor that makes a Nikah valid. This article explores the significance of women’s consent in marriage, the principles set by the Quran and Hadith, and how Islamic teachings protect women from forced marriages. It also addresses common misunderstandings and highlights the moral, social, and legal importance of ensuring that women’s rights are upheld in marriage decisions. By giving women the right to choose, Islam promotes justice, dignity, and equality in family life.

Keywords: Core concepts of Nikah, special types of marriage, women’s consent in Islamic sources, women’s consent in four Sunni schools of thought, legal perspectives, impact of forced marriage.
