A Jurisprudential Study of Human Rights in Tafsiri Literature

Abstract

This research article presents a jurisprudential study of human rights within the realm of interpretive literature, specifically focusing on classical and modern exegetical works of the Holy Qur'an. The primary objective is to uncover how foundational human rights principles such as the right to life, dignity, justice, freedom of belief, and equality have been theoretically and practically articulated through various interpretive texts. By analyzing key exegetical methodologies ranging from traditional to contemporary, the study highlights a dynamic evolution in the understanding of these rights, often influenced by socio-political contexts and intellectual exchanges. The research employs a qualitative analytical approach, drawing upon primary sources of Tafsiri literature and secondary critiques of Islamic jurisprudence. Initial findings suggest that interpretive literature not only preserves a rich heritage of human rights discourse but also offers flexible legal frameworks that can adapt to modern ethical challenges. Furthermore, the article examines the hermeneutical misunderstandings between literal and contextual interpretations of divine texts, revealing a spectrum of juristic opinions that range from restrictive to expansive readings of human entitlements. Ultimately, this study concludes that a humanized and contextual re-engagement with Tafsiri literature can significantly contribute to contemporary human rights theory, bridging classical legal principles with universal ethical values. The article calls for an interdisciplinary approach that marries traditional exegesis with modern legal philosophy to foster a more inclusive understanding of human dignity and rights in Muslim societies and beyond.
